IRS Penalty Abatement Services

Reduce or Remove Tax Penalties

Start With a FREE Penalty Abatement Consultation

If you owe back taxes to the IRS or a state agency, the final number you owe can cause quite a shock because chances are it’s higher than the original amount. Why? Because the IRS adds penalties to your balance starting on the first day your payment or tax return is late.

Late penalties can get close to 50% of your original balance, and interest accrues on them as well as on the principal. Over time, this can easily double what you originally owed and keep climbing. The result? A cycle of what feels like inescapable debt.

At America Tax Group, we understand how overwhelming tax penalties can become. You don’t have to settle for an inflated bill. Our team of enrolled agents, CPAs, and tax attorneys specializes in working directly with the IRS or state agencies to reduce or eliminate these extra fees. The process is called penalty abatement.

How We Help You Abate IRS Penalties

There’s a solution for every tax problem. The IRS won’t drop penalties if you just ask nicely, but they often will if you present a legally sound defense supported by the right evidence. America Tax Group can provide a clear, strategic approach to requesting penalty relief. We’re with you every step of the way.

Our team will protect your finances by:

  • Analyzing your official IRS transcripts to see whether you qualify for automatic relief programs.
  • Coordinating your abatement request with your broader tax strategy to maximize the total dollar amount removed.
  • Drafting a written defense that explains why you weren’t able to file or pay on time due to circumstances beyond your control.
  • Organizing your medical records, fire reports, financial statements, death certificates, or other documentation to support your claim.
  • Petitioning the IRS to return money you’ve already paid in tax penalties within the past two years.
  • Handling the formal appeals process to fight for a reversal if the IRS rejects an initial administrative request.

Every case is different, and America Tax Group develops customized strategies based on each client’s financial situation and goals.

Why You Need to Take Action Now

Ignoring tax penalties is a costly mistake you don’t want to make. The IRS's automated system applies penalties until you resolve the debt, so your balance will keep growing until it reaches the statutory maximum.

Risks of delaying relief

If you procrastinate, penalties keep accumulating. Because the IRS also charges interest on the penalties themselves, your overall balance will also increase.

But a higher debt isn't the only problem you'll face if you ignore your debt. Left unaddressed, those balances could lead to more aggressive collection actions, like federal tax liens, wage garnishments, bank account levies, asset seizures, or the IRS may assign a revenue officer to your account.

IRS math and why penalties keep growing

To see why delaying relief is so costly, let’s look at how IRS math works when you combine penalties and interest.

Imagine you haven't filed a return that's going to show a $10,000 tax bill. Once you file, the IRS will backdate late filing and payment penalties to your balance. The late filing penalties will stop as soon as you file, but the late payment penalties will continue to accumulate until you pay in full.

The IRS will apply these two penalties that compound with interest simultaneously.

  • Failure-to-file penalty

The IRS charges 5% per month on the unpaid tax for each month your return is late, up to 25%. This penalty drops to 4.5% and caps out at 22.5% when it's applied with the late payment penalty. This adds $2250 to your original $10,000 tax debt.

  • Failure-to-pay penalty

The IRS also charges a 0.5% monthly penalty for late payment, which goes up to 1% per month after a while. That penalty can eventually reach 25%, potentially adding $2500 to your tax liability.

  • The compounding interest loop

The IRS charges interest on the original $10,000 tax bill and the penalties. The rate is the fed rate plus 3 percent. Because the IRS compounds interest daily, the balance can grow very quickly.

If you ignore that $10,000 tax bill for a few years, the penalties will reach their maximum statutory limits, and the daily compounding interest will attach to the entire inflated amount. With a 7% interest rate, your original debt could balloon to over $17,000 in just three years, and it'll keep climbing.

Missed deadlines

The IRS gives you two deadlines to request penalty abatement (removal before paying) or refunds (removal after paying). You have until the latter of these two:

  • Three years after the return's original filing deadline.
  • Two years after you paid the tax.

Reducing your overall balance through penalty abatement can also make it easier to qualify for long-term resolution programs or make your monthly payments more manageable.

Options for Reducing or Removing IRS Penalties

The IRS offers several administrative relief options. Our job is to identify which one matches your tax compliance record and financial situation and then help you get relief.

  • First-Time Penalty Abatement (FTA)

An administrative waiver designed for taxpayers with a clean compliance history. If you’ve filed and paid on time for three years leading up to the penalty year, we can often get the failure-to-file and failure-to-pay penalties expunged.

  • Reasonable Cause Abatement

If you don’t qualify for FTA, we can seek relief by proving that an extenuating circumstance (e.g., illness, natural disaster, bad professional advice, death in the immediate family) prevented you from compliance.

  • State Penalty Abatement

Because state tax departments have different rules than the federal government, we tailor separate abatement petitions specifically to align with the state-level criteria.

Taxpayers can request penalty relief by calling the IRS, filing Form 843, or writing a letter to ask for relief, but the easiest and safest way to get relief is by working with our firm.

Integrating penalty relief with broader tax resolution strategies

Penalty reduction is often one part of a more comprehensive tax defense plan. Once we’ve minimized your penalties, America Tax Group can help integrate your remaining tax debt into alternative, long-term resolution options:

When to Hire a Tax Professional for Penalty Abatement

While you can sometimes resolve minor, one-time late fees with a call to the IRS, professional help becomes valuable (and often necessary) if you face any of the following:

  • High dollar balances because your penalties have grown to thousands of dollars, and you can’t clear the balance with one payment.
  • Prior IRS denials of a penalty abatement request that you wrote and submitted on your own. You only have one chance to appeal if the IRS rejects your first abatement request.
  • Complicated corporate liabilities where your business faces recurring penalties for payroll taxes or late information filings, where rules are less forgiving.
  • Owing back taxes and penalties across multiple years, requiring a sequenced abatement strategy across different tax periods.
  • Penalties added by mistake, since the IRS can make administrative errors or apply penalties to accounts that were actually compliant.
  • Federal and state (or multi-state) penalties, such as a business operating across multiple states, or if you’ve moved and carry an outstanding federal and state tax balance.

While you can try a do-it-yourself approach to solving your tax problem, a professional knows how to make arguments that convince the IRS to abate penalties.
